Maazimio ya Kamati za Bunge -Wabunge: Serikali itumie risiti za elektroniki

Major  Highlights

1.) Kutokana na kutokuwepo na taarifa sahihi kuhusu deni la Taifa kuna umuhimu wa kukutanisha wadau wakuu wanaohusika hususani BOT, HAZINA, Kamati za Bunge na CAG ili kuweza kujua kwa usahihi zaidi ukubwa wa deni hilo.  Vile vile imeamuliwa kuwa Serikali ishauriwe kuunda chombo huru kitakachosimamia deni la taifa.

2.) Sheria ya Maadili ya Viongozi wa Umma haiweki uwazi wa kutangaza umiliki wa mali za viongozi.  Hii inapelekea viongozi kutoweka wazi mali wanazomiliki na ni rahisi mtu kuzushiwa umiliki usio wa ukweli.  Ni vyema Sekretarieti wakafanya utafiti wa umiliki wa mali kwa viongozi wa Umma na kuweka taarifa hizo katika tovuti ya Sekretariati ili kuwawezesha wananchi kuweza kuona mali zinazomilikiwa na viongozi wao; na pale ambapo kiongozi hatakuwa ametoa taarifa ya umiliki huo basi taarifa hiyo itolewe kwa Tume.

3.) Kwa kuwa leseni za udereva za sasa zinaweza kuweka kumbukumbu za makosa ya usalama barabarani, basi TRA ikishirikiana na  Wizara ya Mambo ya Ndani zihakikishe ya kuwa Askari wa Usalama Barabarani wanatumia utaratibu huu wa kisasa wa kutoa  “notification” na kutoa risiti za malipo za elektroniki.

4.) Maduhuli ya Serikali sasa yakusanywe kwa kutumia risiti za elektroniki.  Serikali Kuu, Serikali za Mitaa na Mashirika ya Umma yaanze kutumia risiti za eletroniki mara moja ili kudhibiti upotevu wa mapato ya serikali yanayotokea hivi sasa katika kutumia risiti zinazoandikwa kwa mkono. Pia ofisi za serikali zifanye manunuzi yake kwa wafanyabiashara wanaotumia mashine za kielektroniki.

5.) “The Proceeds of Crime Act, 1991” ifanyiwe marekebisho na kuweka kifungu kinachomwezesha AG/DPP kuwa na mamlaka ya kuomba mahakama kufungua kesi ya madai (Civil Forfeiture) kwa watu wanaotuhumiwa kwa ufisadi.

How we lost USD 308m as Tax Revenue from sale of Zain Africa assets in Tanzania to Bharti Airtel

Tanzania Revenue Authority(TRA) informed the POAC that Tanzania lost USD 308m as Tax revenue from sale of Zain Africa assets in Tanzania to Bharti Airtel.

How we lost the Revenue:

*TRA argues that we lost revenue because assets in Tanzania were not sold since its owner did not change. These are tax planning measures ‘complex registration mechanisms’  were used.

*There is a ghost company called Celtel BV which owns Celtel Tanzania and itself owned by Celtel Africa. Celtel Africa was sold to Zain and then to Bharti Airtel but Celtel BV conituned to own Zain Tanzania and even now Airtel Tanzania. So they avoided tax and will continue doing so unless we change our laws to curb tax avoidance measures.

*We(POAC) have directed Hazina to bring an investigation report on the matter within a month with proposals to change/improve our laws.

*We have also instructed Hazina to start a process of divestment of  50% of its shares to the public through the Dar-es-Salaam Stock Exchange(DSE) so as to improve corporate goverance(transparency) & curb transcations costing the Nation. This will help us to see the true valuation of shares as a response to any transactions.

*Ownership structure: Celtel Africa BV owns Celtel Tanzania BV which owns Celtel Tanzania Limited. Celtel Tanzania BV is strategic for tax purposes.
